● “Tour”: Any guided travel experience provided by TrotAfrica, including but not limited to safaris, eco-tours, cultural excursions, and other travel-related services.
● “Booking”: The act of reserving a tour, safari, or travel package with TrotAfrica Eco Safaris Limited, either online, by email, by phone, or in person.
● “Tour Date”: The scheduled date on which the tour is set to commence.

4. Booking and Payment Terms
4.1 Booking Procedure
● All bookings must be made through our website, by phone, or via email. ● A booking is confirmed only when a non-refundable deposit of 30% of the total tour price is paid at the time of booking.
● Full payment is required no later than [30 days] before the scheduled tour date.
4.2 Payment Methods
TrotAfrica accepts the following payment methods:
● Bank transfers to our official account.
● Mobile payment options such as M-Pesa.
● Credit card payments via secure online payment gateways.
4.3 Pricing
● All prices are quoted in Kenyan Shillings (KES/USD or EUROS)
● Prices are subject to change without prior notice. However, once a booking is confirmed with payment as provided under clause 4.1, the price is locked.
● Taxes and service charges are included unless otherwise stated.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
If you wish to cancel your booking, the following cancellation fees will apply:
● More than 60 days before the tour date: Full refund minus the deposit. ● 30 to 60 days before the tour date: 30% of the total tour price will be refunded. ● Less than 30 days before the tour date: No refund.
5.2 No Show Policy
If a customer fails to show up for the tour without prior notice, no refund will be issued.
6. Modifications to Booking
If you wish to modify your booking (e.g., change the tour date, group size, or itinerary), the following applies:
● Modifications must be made at least 30 days prior to the tour.
● Depending on availability, modifications may incur an additional fee.
● TrotAfrica will do its best to accommodate your requests, but modifications are subject to availability and cannot be guaranteed.
7. Customer Responsibilities
By booking a tour with TrotAfrica Eco-Safaris Limited, you agree to the following: 7.1 Health and Safety
● You must inform us of any medical conditions, disabilities, or special needs that may affect your ability to participate in the tour.
● You are responsible for ensuring that you are physically capable of participating in the activities planned for the tour.
7.2 Behavior
● You must comply with the instructions of your tour guide and any other personnel. Failure to do so may result in removal from the tour without refund.
● Customers must respect local cultures, traditions, and laws. We reserve the right to terminate your participation in the tour if your behavior is deemed disruptive or dangerous.
7.3 Travel Documents
● You are responsible for ensuring that you have valid travel documents, including but not limited to a valid passport, visa (if applicable), and any required vaccinations.
8. Liability and Limitations
8.1 Tour Participation
● TrotAfrica Eco-Safaris Limited acts as an intermediary in arranging travel services, including transportation, accommodation, and activities. While we strive to ensure a smooth experience, we are not liable for any direct or indirect damages, losses, or injuries incurred during the tour.
8.2 Force Majeure
● TrotAfrica Eco-Safaris Limited is not responsible for any delays, cancellations, or changes to the tour due to events beyond our control, including but not limited to natural disasters, political unrest, strikes, or pandemics.
8.3 Personal Injury or Loss
● You participate in the tour at your own risk. TrotAfrica Eco-Safaris Limited is not liable for any injury, loss of property, or death occurring during the tour unless caused by negligence on our part.
9. Travel Insurance
We strongly recommend that all customers purchase comprehensive travel insurance to cover potential risks, including but not limited to:
● Cancellation or interruption of the tour.
● Medical expenses and repatriation.
● Loss or theft of personal property.
10. Privacy and Data Protection
TrotAfrica Eco-Safaris Limited respects your privacy and is committed to protecting your personal data. Any personal information we collect will only be used for booking purposes, communication, and to improve our services. We will not share your data with third parties unless required by law or necessary for the execution of your tour.
11. Intellectual Property
All intellectual property rights (including but not limited to logos, photographs, videos, and content) related to TrotAfrica Eco-Safaris Limited are owned by the company. You are not permitted to use, reproduce, or distribute these materials without prior written consent.
12. Dispute Resolution
In case of any dispute, both parties agree to resolve the matter amicably. If the dispute cannot be resolved informally, it will be referred to arbitration under the laws of the Republic of Kenya.

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya.
